《死刑的适用及其价值取向》主要内容：通过梳理中、西方死刑存废之争的思路，明确死刑保留论的坚实基础在于维护正义、保卫社会；死刑废除论的坚实基础在于超越正义、追求人道。在此基础上，作者提出重构刑法的价值体系：基本价值在于追求秩序，终极价值在于保障自由；刑罚是实现刑法价值的基本工具，正义是刑罚的基本价值，人道是刑罚的修正价值，主要体现为禁止酷刑。废除死刑实际上是人道价值对于正义价值的超越，但是这种超越尚不符合我国目前由社会物质生活条件决定的社会道德观念，不过正义价值也可能逐渐被人道价值浸润从而刑罚逐渐轻缓。只有对于有预谋地杀死无严重过错的被害人或者在价值上相当于这种情形的犯罪才能判处死刑；对于有被害人的犯罪，如果通过恢复性司法能够与被害人达成和解协议的犯罪人，原则上也不应当判处死刑。
