The Setback at the Airport
As Beijing was then an epidemic area of SARS and doctors were the high-risk population that often contacted the SARS patients directly, the entry visas of various countries were stricter than normal times. Particularly approved by the Algerian Government, the CISAR got the special visa to enter Algeria. But for caution’s sake, and to ensure the SARS disease would not be brought into Algeria, the Chinese Government required that all the CISAR members should, besides accepting routine security checks, make rigid health condition declaration and receive numerous body temperature measurements.
Dr. Peng Bibo got ill. It was unknown whether it was because of the hot whether or because he was too tired after getting ready the vaccines. This man, who was in very good health at ordinary times, was found to have a body temperature of over 37℃ on the screen of the electronic body temperature monitor when he received the physical examination. Once, twice, three times, the common red numbers became so fearsome, and sweat was pearling over his forehead.
“Low fever!” In the SARS period, anybody associated with these words would keep all others around far away from him. The task-specific Boeing 767 was standing by on the apron, and the huge roars of the engines had sounded up. Everybody present was looking at Peng Bibo, anxiously but solicitously.
When the external environment changes suddenly, the physical and psychological state of the human body will be in a stress state and the secretion of hormones will increase or decrease correspondingly, and the body temperature may fluctuate thereupon. Injected with active vaccines such as cholera vaccine, encephalitis vaccine or hepatitis B vaccine, the human cells will accept or refuse the active ingredients in the vaccines. And for different personal physiques, symptoms of body temperature fluctuation or nausea may arise within 48 hours.
Wang Faqiang, president of the PAPF General Hospital who was seeing them off, carefully inquired about and verified Peng’s body temperature checks, his working situation and his routine over the week, and combined with his clinical experience in treating SARS, he judged that Peng Bibo was very unlikely to have been infected with SARS. “Sit quietly and breathe deeply.” Peng Bibo sat in a corner alone, trying hard to calm down the surging emotions and thoughts. After he became calm, he received a test again and his body temperature recovered back to normal. Then the special plane for relief operations flew away in the eyesight of the people present.

The Labor Law of thePeoples Republic of China, which came into effect on Jan 1 1995, is the productof the reform of Chinas socialist market economy. The implementation of theLabor Law facilitated Chinas reform. Since the implementation of the Labor Law,the employment structures in China have changed dramatically, with some changesincluding the rapid development of the industrial and service sectors;increasing migrant rural workers; the incorporation of the state?owned enterprises; the standardization of private enterprises andthe localization of foreign?invested enterprises. Thehuman resources industry has also flourished in every area, including the humanresource legal service.
It was in 2015, the20th year since the implementation course of the Labor Law, the 20th year ofpracticing as a lawyer, and the 12th anniversary of my establishment of RiverDelta Law Firm, that I decided to write this book. Confronting several setbacks,the book is finally finished 2 years later. Even in these 2 years, some majorlabor related policies in China have emerged, including the implementation ofthe "universal two child" policy, the plan to raise the retirementage, the plan to combine maternity insurance and basic medical insurance, andchanges to Chinese policies on employment of foreigners. Fortunately, althoughdifferent understandings in labor and employment law exist in local practice,and the labor related policies have changed at the national level, China is acomplex but unitary country. Comprehensive knowledge about state policycontributes to a deep understanding in local practice, and thus the former isthe focus of this book.
This book isconceptualized as the first practical book introducing Chinese labor andemployment law which is authored by a Chinese legal practitioner. The book isprovides an overview of the law.The content of this book is intended only toprovide a summary and general overview on Chinese employment law. It is notintended to be comprehensive, nor does it constitute legal advice. The authorhas attempted to ensure that the content is accurate, but does not guaranteethe accuracy of the book for your circumstances. You should seek specific legalor other professional advice catered to your circumstances and should not actor rely on any of the content in this book. which is useful for foreignenterprises operating in China or who deal with Chinese companies. This book has adoptedthe structure of the Labor Law, rather than using labor law theory as a basis.The book adopts an enterprise management approach and is written with a globalvision. The book initially establishes the general rules governing the employmentrelationship and integrating the experience of River Delta Law Firms nativelawyers.
Nevertheless, theregulatory framework governing Chinese labor and employment relations isinherently complex. There are numerous and convoluted laws, regulations andcases governing different aspects of employment, with new exceptions emergingalmost immediately as principles are established. This is the reflection of thehistorical development of Chinas labor and employment legislation, and therapid industrial changes occurring today. This book does not purport to coverall of the complex and growing field of employment relations.
In addition to theconstant proliferation of new laws and exceptions, the words in existing lawsoften take on new meanings to adapt to changing practical realities. Theconsequence is that the rights and obligations of employers regularly change.Inherent tensions between employers and employees will always characterize theemployment relationship, no matter how harmoniously the drafters of legislationwish it to operate. The number of labor disputes is still increasing over thepast few years. Collective stoppages and group incidents occur from time totime. Meanwhile, as the new economy corporations rise, the instinct to evadecompliance with laws, including labor laws, still widely exists. This leads toa clear conflict between regulation and development, while the undercurrentvalue is the collection and analysis of the big data based upon the arithmeticand code, even generating the conflict between artificial intelligence andhuman beings. Therefore, the reform of labor and employment law in China isalways ongoing.
